General Terms and Conditions of the Online Store

(for distance sales contracts concluded through the e-commerce system)

Article I

(hereinafter referred to as the “Seller”)

  1. These Terms and Conditions govern the rights and obligations between the Seller and the Buyer arising from the sale of goods through the online store.
  2. The Buyer is any natural or legal person who submits an order through the online store.
  3. A Consumer is a natural person who, when concluding and performing the contract, is not acting within the scope of their business activity, trade, or profession.

Article II

Orders and Conclusion of the Contract

  1. An order is created by selecting goods, adding them to the shopping cart, and confirming the order.
  2. Before submitting the order, the Buyer has the opportunity to review and correct the information entered.
  3. By submitting an order, the Buyer confirms that they have read and agree to these Terms and Conditions.
  4. The purchase contract is concluded upon delivery of the Seller’s order confirmation to the Buyer’s e-mail address.

Article III

Prices and Payment Terms

  1. All prices are stated in EUR.
  2. The Seller is not a VAT payer. Should this status change, prices will be displayed inclusive of VAT.
  3. The cost of delivery, according to the selected shipping method, is added to the total order price.
  4. Payment may be made by:
  • payment card via Stripe,
  • PayPal,
  • bank transfer.

Article IV

Delivery Terms

  1. The Seller shall deliver the goods without undue delay and no later than 30 days from the conclusion of the contract, unless otherwise agreed by the parties.
  2. The risk of damage to or loss of the goods passes to the Consumer upon receipt of the goods.
  3. Upon delivery, the Buyer is obliged to inspect the shipment and report any damage to the carrier.

Article V

Consumer’s Right of Withdrawal

  1. The Consumer has the right to withdraw from the contract without giving any reason within 14 days from the date of receipt of the goods.
  2. The Consumer may withdraw from the contract:
  1. The online withdrawal function is easily and continuously accessible to the Consumer throughout the entire withdrawal period.
  2. The Seller shall promptly acknowledge receipt of the withdrawal on a durable medium, in particular by e-mail.
  3. The Consumer must return the goods no later than 14 days from the date of withdrawal.
  4. The Consumer bears the direct costs of returning the goods.
  5. The Seller shall reimburse all payments received no later than 14 days from the date of receipt of the withdrawal notice.
  6. The Seller is not obliged to issue a refund before the goods have been returned or until the Consumer provides proof that the goods have been dispatched back.
  7. The Consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functionality of the goods.
  8. The Consumer may not withdraw from the contract in cases specified by Act No. 108/2024 Coll., particularly in relation to goods supplied in sealed protective packaging that are unsuitable for return for hygiene reasons and where the protective seal has been broken after delivery.

Article VI

Liability for Defects

  1. The Seller is liable for defects that exist at the time of delivery and that become apparent during the statutory liability period.
  2. The Consumer is obliged to notify the Seller of a defect without undue delay after discovering it.
  3. The Consumer may exercise rights arising from liability for defects:
  • by e-mail,
  • in writing,
  • through the complaint form available on the website.
  1. The Seller shall provide the Consumer with confirmation of the defect notification.
  2. The Seller shall handle complaints within the statutory time limits in accordance with applicable legal regulations.

Article VII

Alternative Dispute Resolution

  1. The Consumer has the right to contact the Seller with a request for redress.
  2. If the Seller rejects the request or fails to respond within 30 days, the Consumer has the right to initiate alternative dispute resolution proceedings pursuant to Act No. 391/2015 Coll.

Article VIII

Personal Data Protection

  1. The Seller processes personal data in accordance with the GDPR and Act No. 18/2018 Coll. on Personal Data Protection.
  2. Detailed information regarding the processing of personal data is provided in a separate document entitled “Privacy Policy.”

Article IX

Final Provisions

  1. Legal relationships not governed by these Terms and Conditions shall be governed primarily by:
  • the Civil Code,
  • Act No. 108/2024 Coll. on Consumer Protection,
  • Act No. 22/2004 Coll. on Electronic Commerce,
  • Act No. 391/2015 Coll. on Alternative Dispute Resolution for Consumer Disputes,
  • and other applicable laws of the Slovak Republic.
  1. These Terms and Conditions become effective on the date of their publication on the Seller’s website.
